CANCELLATION BY YOU
For a full refund, cancel at least 48 hours in advance of the start time and date of your booking. Cancellation must be made by phone or SMS to 0444-515-212, email firstname.lastname@example.org
CANCELLATION BY US
Our trips are guaranteed to depart once they have three (3) fully paid travellers. We may cancel a trip 16 hours in advance of the start time and date if only one (1) or two (2) traveller has booked for a trip. If we cancel your trip, you can transfer amounts paid to an alternate travel date or receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control (eg. cyclone or severe weather events) refunds will be provided. We are not responsible for any incidental expenses that you may have incurred as a result of your booking.
If you want to transfer from one trip to another or transfer your booking to a different date an administration fee of $30 per seat will apply.
You will travel in a 4 seat Toyota Camry SL (or similar). The vehicle has air conditioning and comfortable leather seats throughout. All seats have over the shoulder and across the waist seat belts.
Travel to and from your destination. English commentary. Drinking water provided.
Food, drinks and discretionary purchases.
Our trip prices are subject to seasonal pricing, which is standard practice within the travel industry. This means trip prices may change at any time in accordance with demand, market conditions and availability. It is possible that different passengers on the same trip have been charged different prices. Any reduced price or discounts that may become available after you have paid will not apply. If you cancel your booking to take advantage of a cheaper price, cancellation fees may apply.
Please appreciate and acknowledge our trips sometimes require flexibility and you should allow for alternatives. The itinerary provided for each trip is a representation of the activities anticipated, but it is possible that the route, schedules, itineraries, and amenities may be subject to alteration without prior notice due to circumstances or events.
Optional activities not included in the trip price do not form part of the trip. You accept that any assistance given by your tour leader or local representative in arranging optional activities does not render us liable for them in any way. The provision of that activity will be between you and activity provider.
You consent to us use of your images taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.

Our trips are run by a tour leader. The decisions made by the tour leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a tour leader, or interfere with the well-being of the tour, the tour leader may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must at all times comply with the state and federal laws in Australia.
We connect with companies, agencies and individuals to assist in the running of our trips as an agent for said third parties. We are not responsible for the acts and omissions of these third parties.
To the fullest extent permitted by law:
• Any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip, or any breach of these Terms and Conditions, is excluded;
• You release Dear Australia, and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip; and any condition or warranty which would otherwise be implied by law into these Terms and Conditions (Implied Warranty), is excluded.
To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion): (1) the provision of a similar trip to an equivalent value; or (2) a refund of the total amount received by us from you in connection with your booking.
Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.
CLAIMS AND COMPLAINTS
If you have a complaint about your trip, please inform the tour group leader or our local representative at the time in order that they can attempt to rectify the matter. If satisfaction is not reached through these means, then any further complaint should be put in writing to us within 14 days from the end of the tour.
In the event that any term or condition contained in these Terms and Conditions is unenforceable or void by operation of law, or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from these Terms and Conditions or amended accordingly only to such an extent necessary to allow all remaining Terms and Conditions to survive and continue as binding.
The laws of Queensland, Australia govern these Terms and Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Terms and Conditions must be initiated in the courts of Queensland, Australia.
